Oasis Live '25

    Pre-Sale Ballot Details

  1. This is a private pre-sale ballot for the ‘Australian Oasis Live ‘25 Tour’ dates announced on official Oasis channels (the “Pre-Sale Ballot”). The purpose of this Pre-Sale Ballot is to give you the chance to be selected to receive an access code (“Pre-Sale Access Code”) for a chance to purchase tickets for the ‘Australian Oasis Live ‘25 Tour’ in the invite-only pre-sale (the “Pre-Sale”).
  2. By registering for this Pre-Sale Ballot you agree that you have read and understood these Terms and Conditions (“T&Cs”) and agree that you will be bound by them. These T&Cs govern your relationship with the organiser of this Pre- Sale Ballot, Big Brother Recordings Ltd. of 88-90 Baker Street, London, W1U 6TQ (the “Organiser”).

    Participation

  3. In order to proceed with registration for the Pre-Sale Ballot, you must be registered with ‘Oasismynet’. Oasismynet is the new online home for Oasis fans to get access to exclusive content, giveaways and tailored updates in respect of the band, operated by Openstage on behalf of Oasis and their record label Big Brother Recordings Ltd. If you are not yet registered on Oasismynet you will be required to register as part of your application for the Pre-Sale Ballot. You may unregister from Oasismynet at any time after the Pre-Sale Ballot closes by clicking the ‘Unsubscribe’ link in the welcome email sent to you at registration, by using the oasis.os.fan platform, or by emailing support@openstage.live.
  4. The Pre-Sale Ballot sign-up window begins at 8am AEDT on Tuesday 8th October 2024 (the “Starting Time”) and closes at 8am AEDT on Wednesday 9th October 2024 (the “Closing Time”) (collectively the “Sign-Up Window”).
  5. To register for this Pre-Sale Ballot you must complete the Openstage Pre-Sale Ballot registration form provided via Oasismynet, including selecting which show of the ‘Australian Oasis Live ‘25 Tour’ you would like to purchase tickets for (your “Registration”). Your Registration must be received by the Organiser by no later than the Closing Time in order to enter the Pre-Sale Ballot. For the avoidance of doubt no Registrations will be counted before or after the Sign-Up Window.
  6. No purchase is necessary to register for the Pre-Sale Ballot and there is no charge to register on Oasismynet or to complete or submit the Registration form.
  7. If you are aged under 18 years old (as of the time of your Registration) you must have your guardian’s permission to enter this Pre-Sale Ballot.
  8. To enter this Pre-Sale Ballot your Registration must include the email address associated with your Ticketmaster account. If you do not have a Ticketmaster account please set one up before registering for the Pre-Sale Ballot.
  9. The email address you provide in your Registration must be capable of receiving emails in order for the Organiser to provide you with a Pre-Sale Access Code in the event you are randomly selected in the Pre-Sale Ballot. There are no restrictions on countries or regions for registration for the Pre-Sale Ballot.
  10. The Organiser (and its licensees, affiliates and assigns) reserves the right to cancel the Pre-Sale Ballot or amend these T&Cs without notice including in the event of circumstances outside its control, including without limitation, a major catastrophe, war, civil or military disturbance, strike, flood, earthquake, any communicable disease (including without limitation the novel corona virus known as “Covid-19”), or any actual, anticipated or alleged breach of any applicable law or regulation or any other similar event. No liability shall attach to the Organiser as a result thereof.
  11. Employees and their immediate families of the Organiser and any of their subsidiaries and/or agencies associated with this Pre-Sale are ineligible to enter the Pre-Sale Ballot. Any such entries will be invalid.
  12. Only one Registration per person. Registrations on behalf of another person will not be accepted and joint submissions are not allowed.
  13. Your standard telephone, internet, network and data charges will apply (there is no additional charge to enter this Pre-Sale Ballot) and you must have the bill payer’s permission prior to entering the Pre-Sale Ballot.
  14. The Organiser will not accept:
    1. responsibility for Pre-Sale Ballot entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
    2. proof of posting or transmission as proof of receipt of Registration to the Pre- Sale Ballot.

    The Ballot

  15. After the Closing Time, all Registrations will be put into “pots” with each pot corresponding to the ‘Australian Oasis Live ‘25 Tour’ show location the entrants have expressed an interest in attending on their Registration form.
  16. Registrations will be selected from each pot at random by the Organiser (at the Organiser’s sole discretion) to arrive at the required number of successful ballot entrants in respect of each live show location (referred to herein as the “Successful Ballot Entrants”). The decision of the Organiser is final and no correspondence or discussion will be entered into.
  17. Successful Ballot Entrants will be sent a Pre-Sale Access Code by email from Openstage on behalf of Oasismynet to the email address specified in their Registration on Friday 11th October 2024. If you do not receive that email by that time, this means your Registration has not been successful in the Pre-Sale Ballot.
  18. Successful Ballot Entrants can claim a maximum of one (1) Pre-Sale Code per Registration. Successful Ballot Entrants must have a Ticketmaster account registered to the email address provided in their Registration in order for the Pre- Sale Access Code to work.
  19. Pre-Sale Access Codes will be generated by the Organiser. Pre-Sale Access Codes have no cash value (and no cash alternatives shall be available), and are non- transferable, case-sensitive, and good for one-time use only for limited tickets during Pre-Sale window.
  20. Pre-Sale Access Codes must be used with the email address to which a Registration was registered and to which that Pre-Sale Access Code was originally sent. Pre-Sale Access Codes must be used with the email address associated with a valid Ticketmaster account.
  21. In all cases the Organiser (and its licensees, affiliates and assigns) shall not be liable for any email notification that does not reach the Winner for reasons beyond the Organiser’s (and its licensees’, affiliates’ and assigns’) reasonable control.

    The Pre-Sale

  22. The Pre-Sale will be operated by Live Nation (the “Promoter”) and Ticketmaster or their associated, affiliated or subsidiary companies. To participate in the Pre-Sale you must use the email address associated with your Ticketmaster account. If you do not have a Ticketmaster account please set one up before registering for the Pre-Sale Ballot.
  23. Ticket sales are limited to four (4) tickets per person. Ticketmaster and the Event Organiser do not guarantee the authenticity of tickets purchased from unauthorised third party resellers or resale sites. The venue reserves the right to refuse admission for invalid tickets or tickets purchased in breach of these terms.
  24. Only a limited number of tickets are available for all Successful Ballot Entrants. Tickets will be offered on a first come first served basis. Please note that there is no guarantee that Successful Ballot Entrants will be able to buy tickets to any of the eligible dates using a Pre-Sale Access Code.
  25. Tickets are sold on behalf of the Promoter to the consumer. Business or traders are specifically prohibited from purchasing tickets for the Australian Oasis Live ‘25 Tour. Any who do so may have their tickets cancelled.

    Ticket Sales

  26. Ticket resale is permitted at no more than 110% of the price you paid for your tickets. Please only use the official resale partners www.twickets.live and Ticketmaster. Selling tickets through unauthorised resale platforms for amounts that exceed 110% of the price you paid for your tickets will breach these T&Cs and those tickets may be cancelled, and doing so may breach legal requirements in some States of Australia.
  27. A ticket is a personal, revocable license and, at all times, remains the property of the Event Organisers. Tickets must be surrendered to the Event Organisers upon request.
  28. This ticket is sold on behalf of the Event Organisers to the Consumer.
  29. All ticket sales data will be manually forensically examined and any use of bots, multiple identities, false identities, or other fraudulent means of acquiring tickets may be reported to Fair Trading and law enforcement bodies in Australia, and any such tickets may be cancelled.

    Submitted Material

  30. By entering the Pre-Sale Ballot you warrant and represent that your Registration does not and shall not contain any material that, in the Organiser’s sole discretion, is improper including but not limited to information that: (i) impersonates any person or entity, or falsely states or otherwise misrepresents your affiliation with a person or entity, without such person or entity’s prior written consent; (ii) constitutes or includes any personally identifying information or other personal or identifying information about you or any individual; (iii) is false, deceptive, misleading, scandalous, indecent, criminally obscene, pornographic, unlawful, blasphemous, defamatory, libelous, fraudulent, tortuous, threatening, harassing, hateful, degrading, intimidating, or racially or ethnically offensive, or contains nudity, pornographic images, explicit sexual themes or graphic violence; (iv) encourages conduct that could be considered a criminal offense, could give rise to criminal civil liability, or could violate any law, or that could otherwise be considered inappropriate; (v) constitute a virus, worm, Trojan horse, Easter egg, time bomb, spyware, or other computer code, file or program that is harmful or invasive or may, or is intended to damage or hijack the operation of, or to monitor the use of, the Organiser or any hardware, software, or equipment; (vi) constitutes any advertising, promotional material, or other form of solicitation; (vii) constitutes any non-public information about a company; (viii) includes any other party’s copyright or other intellectual property; or (ix) has been submitted in bulk or by “bots”.
  31. The Organiser may at its sole discretion opt not to use, without notice or reason, any Registration that it believes is inappropriate or in breach of these T&Cs.
  32. In entering this Pre-Sale Ballot, you confirm that you are eligible to do so and are eligible to claim any Pre-Sale Access Code. The Organiser may require you to provide proof that you are eligible to enter this Pre-Sale Ballot.
  33. The Organiser will not accept Registrations that are:
    1. automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);
    2. completed by third parties or in bulk;
    3. illegible, have been altered, reconstructed, forged or tampered with;
    4. photocopies and not originals; or
    5. incomplete.
  34. The Organiser reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of this Pre-Sale Ballot.

    General Terms

  35. Registrations that are incorrect or incomplete will be void. No refund will be made for any costs incurred in respect of any Registration or participation in the Pre-Sale Ballot. The Organiser may refuse to award a Pre-Sale Access Code, or withdraw your Registration, in the event of your fraud, dishonesty or non-entitlement under these T&Cs.
  36. In the event of any fault, mistake, misunderstanding or dispute concerning the operation of any part of the draw, the decision of the Organiser shall be final.
  37. The Organiser assumes no responsibility for damages, losses or injuries that result from your participation in this Pre-Sale Ballot or acceptance or use of a Pre-Sale Access Code, provided that nothing in these T&Cs shall exclude or limit the Organiser’s liability for death or personal injury caused by its staff or supplier’s negligence or for fraud. Your statutory rights are not affected.
  38. The Organiser (and their respective licensees, affiliates and assigns) make no warranties, and hereby disclaim any and all warranties, express or implied, concerning any participation in connection with this Pre-Sale Ballot. The Organiser (and their respective licensees, affiliates and assigns) is not responsible for any incorrect or inaccurate information, reviews, ratings, rankings, or other materials, whether caused or created by authorized web site users, by tampering or "hacking," or by any of the equipment, software, or programming related to the Pre-Sale Ballot and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, or unauthorized access to the Pre-Sale Ballot. Additionally, the Organiser is not responsible for any cancellation of the Pre-Sale Ballot and/or the Pre-Sale. Successful Ballot Entrants accept the Pre-Sale Access Codes entirely at their own risk. If, for any reason, the Pre-Sale Ballot and/or the Pre-Sale is not capable of continuing as planned because of (including but not limited to) strikes, industry conditions, marketplace demands, flood, fire, “Act of God”, communicable disease (including without limitation the novel corona virus known as “Covid-19”), or any other causes which, in the sole opinion of the Organiser (and its licensees, affiliates and assigns), could corrupt, compromise, undermine, or otherwise affect the administration, security, fairness, integrity, viability, or proper conduct of the Pre-Sale Ballot and/or Pre-Sale, the Organiser (and its licensees, affiliates and assigns) reserves the right in its sole discretion to modify these T&Cs and/or to cancel, terminate, modify, or suspend the Pre-Sale Ballot and/or Pre-Sale.
  39. You hereby agree to release and hold harmless the Organiser and Oasis, their parent companies, affiliates, subsidiaries, divisions, advertising and promotion agencies and its respective employees, officers, directors, agents, representatives, shareholders and Pre-Sale partners (collectively, the “Releasees”) from any claims, actions, injury, loss or damages of any kind, including but not limited to, any damage to the entrant's or any other person's computer relating to or resulting from participation in, or downloading of any materials or software in connection with, this Pre-Sale Ballot and/or Pre- Sale, personal injury or death (except for liability for death, personal injury and damage or loss caused by negligence by the Organiser which is not excluded) resulting from participating in this Pre-Sale Ballot and/or Pre-Sale or from the acceptance, possession, or use or misuse of any Pre-Sale Access Code awarded or participation in any related activity. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income, or profit; loss or damage to property; and claims of third parties. Eligible participants agree that Releasees have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express or implied (including but not limited to, the implied warranties of merchantability, title, and fitness for a particular purpose), in fact or in law, relative to the Pre-Sale Ballot and/or Pre-Sale or any Pre-Sale Access Code awarded. Without limiting the generality of the foregoing, Releasees do not make any express or implied warranties or representations with respect to any promotional web site and Releasees shall not be liable for the consequences of any interruptions or errors related thereto. These terms give you specific legal rights. The provisions regarding implied warranties are void in some jurisdictions where implied warranties are prescribed by law.
  40. Should one or more provision of these T&Cs be unlawful, void, or unenforceable, such provision(s) shall be deemed severable and will not affect the validity and enforceability of the remaining provisions and the remainder of the T&Cs will thus remain in full force and effect.

    Confidentiality, Privacy and Data Collection

  41. The Organiser does not claim any rights of ownership in your Pre-Sale Ballot Registration.
  42. All personal information provided to the Organiser by way of your participation in this Pre-Sale Ballot shall only be processed by the Organiser and Openstage in accordance with Openstage’s Privacy Policy found at: https://openstage.live/privacy/.
  43. If you have opted-in to receive marketing communications, you consent to the Organiser holding data for future relevant promotional and marketing purposes relating to Oasis and other projects involving the members of Oasis (including the sharing of such personal data with affiliates of the Organiser and its commercial partners) in accordance with Openstage’s Privacy Policy.
  44. If you have opted-in to receive marketing communications, your personal data shall be securely stored by the Organiser and Openstage for marketing and alternative purposes where relevant. You also agree to being added to the Oasis Openstage ‘fan page’, Oasismynet.
  45. You can opt-out of marketing communications at any time by sending an email to info@ignition.co.uk or support@openstage.live and putting “unsubscribe” in the title of the email, or by changing your marketing preferences by clicking the “Update Subscription Preferences” in the footer of any Oasis marketing email.
  46. You agree that the Organiser may make available to third parties the details provided to it in accordance with its legal obligations.

    Law & Jurisdiction

  47. These T&Cs and this Pre-Sale Ballot are governed by the laws of England and Wales and any dispute (including if any entrants to this Pre-Sale Ballot wish to take court proceedings) will be subject to the exclusive jurisdiction of the Courts of England.
  48. Where any applicable law, rule or regulation would conflict with provisions of these Terms and Conditions or render any provision invalid, illegal or unenforceable, nothing in these Terms and Conditions purport to or will seek to prevent the application of such law. Notwithstanding anything to the contrary, these Terms and Conditions do not limit the rights of Australian consumers under the Australian Consumer Law for events in Australia.
